Intellectual Property Protection

All digital content constituting the "Grand Aqar" platform is the exclusive intellectual property of the platform and is protected under local and international copyright laws. This includes the source code, user interface, design, and databases represented by elite real estate listings and matching algorithms. It is strictly prohibited to copy, modify, or reproduce any part of the platform without prior written permission.

1. Prohibited Use: The name "Grand Aqar" and its logo are registered trademarks; their use in any external publications or accounts for any purpose is strictly prohibited.
2. Independence of Entities and Individuals: All users (companies, brokers, agents) acknowledge that they are independent parties and are not employees or legal representatives of "Grand Aqar". No user is permitted to use the platform's logo in a manner that implies an employment relationship or a partnership that misleads clients.

Upon sharing any content through the platform (including descriptive texts, images, audio recordings, video clips, architectural plans, or any other types of content), you, as the data uploader, legally acknowledge and commit to the following:

1. Eligibility and Authorization: You pledge that you are the original owner of this content and the property, or that you possess the legal right and official authorization (as a licensed broker, agent, company representative, or equivalent) to publish this content and grant the platform the rights stipulated in this policy.
2. Full Assumption of Liability: You alone bear—without any joint liability on the part of the platform—all legal, criminal, or financial consequences in the event that the shared content infringes upon the intellectual property rights or privacy of any third party.
3. Protection of Third-Party Privacy: You commit to not including any personal information of third parties in the shared content without obtaining their documented and legal consent.
4. Prohibition of Violating Content: You pledge that the shared content will not contain any defamatory, offensive, misleading, threatening, racist, morally inappropriate materials, or any violations of the real estate marketing requirements stipulated in the regulations of the Kingdom of Saudi Arabia.

Once you upload content and it is accepted on the platform, you explicitly agree to the following terms of use:

1. Absolute License to the Platform: You grant "Grand Aqar" a perpetual, temporally and spatially unrestricted, irrevocable, and unpaid (royalty-free) right, which is distributable and transferable to third parties, to copy, modify, alter, distribute, and publish the shared content without any restrictions, for the purpose of marketing the property across the platform’s various channels.
2. Ownership of Funded Content: In the event that "Grand Aqar" incurs any financial costs to produce or assist in producing the shared content (e.g., dispatching professional photographers, drones, or creating 3D virtual tours of the property), the platform retains the full and exclusive right to own this content, and the client has no right to claim it or use it outside the platform without written permission.
3. Protection of Personal Data: If the shared content includes any of your personal information (such as your name or contact number), the platform's "Privacy Policy" shall govern the use and protection of this information.
4. Watermark: The platform reserves the right to place its watermark on the property's images and videos to protect them from duplication, and this measure is considered an inherent right that is not subject to objection.

1. Prohibition of Copying and Republishing: It is strictly forbidden for any user to save images of properties listed on the platform (which belong to other users) and republish them on competing real estate platforms or personal accounts.
2. Permitted Sharing Mechanism: Marketing the displayed properties is only permitted through the use of official sharing links (Share Links) that redirect interested parties to the "Grand Aqar" website.
3. Poaching of Clients: It is prohibited to use the data available on the platform to bypass the property lister and reach the original owner to conclude the transaction externally.

1. Data Protection (Data Scraping): The use of bots or automated extraction tools to copy real estate databases, prices, or images is prohibited. Any attempt to do so is considered an infringement requiring compensation.
2. Safe Harbor: If content is uploaded without the permission of its original owner, the platform (acting as a neutral intermediary) commits to removing the violating content immediately upon receiving an evidence-based notification. Legal liability is strictly limited to the user who uploaded the content.

In the event that any individual, broker, or entity is proven to have violated intellectual property rights or shared violating content, the administration reserves its absolute right to:

1. Immediate removal of the content and permanent suspension of the violator's account.
2. File a lawsuit with the competent authorities in the Kingdom of Saudi Arabia to demand the cessation of the infringement, impose statutory penalties, and claim financial compensation for losses and damage to commercial reputation.
